ACCESS AND PROVENANCE

The JAMES MARSHALL PAPERS were donated to the American Jewish Archives 
by James Marshall in August, 1982. In January, 1987 the Estate of
James Marshall donated an additional supplement to the papers.

Property rights for the JAMES MARSHALL PAPERS are assigned to the American
Jewish Archives.  All literary rights to materials authored by James Marshall
are held by the Marshall heirs. Literary rights to materials authored by 
others are held by the individual author and his/her heirs. Questions
concerning rights should be addressed to the Director of the American Jewish 
Archives.

BIOGRAPHICAL SKETCH top

James Marshall was born in New York City in 1896 to Louis and Florence
(Lowenstein) Marshall. Like his father, James Marshall pursued and achieved a
distinguished career in law. He studied at the Columbia School of Journalism
(1913-1916) and, following a year as second lieutenant in the Army, received
the LL.B from Columbia in 1920.

In the practice of law, James Marshall's primary concern was with civil
liberties, and his sphere of interests ranged from helping European immigrants
to attacking discriminatory practices among major corporations. His
professional and philanthropic interests led to a simultaneous practice in two
separate law firms along with involvement in numerous associations in the
public sector.

While Marshall functioned successfully as arbitor, administrator,
educator and author, the complete history of his activities is beyond the
scope of this sketch. The following listing, however, is representative of his
interests.

Marshall lectured in public administration at New York University from
1953-1959. He was later instrumental in establishing the Human Relations
Center at Boston University (1966-1970). As lawyer and statesman, Marshall was
involved with the New York Board of Education (1938-1942), the New York City
Charter Commission, the American Jewish Committee (Vice President 1959-1962;
honorary Vice President 1962-1986), the American Jewish Joint Distribution
Committee, the Institute of International Education, the Jewish Publication
Society, the American Association for an International Office of Education
(Vice-President 1943-1947), the Wilderness Society and the NAACP. Marshall was
an integral part of the U.S. Commission for UNESCO, and traveled as a U.S.
delegate to conferences in Paris (1946), Mexico City (1947), Florence (1950)
and Geneva (1959). He was sympathetic to and actively involved in the
development of the Ihud Association under the direction of his uncle, Judah
Magnes.

Marshall served on the board of directors of the New York State Training
School for Boys (President 1934-1935), the Hebrew University, the Martha
Graham Center for Contemporary Dance, the P.E.N. American Center and the
Robert Marshall Civil Liberties Trust. This last position indicates Marshall's
strong sense of family ties. Along with active participation in administering
funds from the Trust, established by the estate of a late brother, Marshall
instigated the research for the publication of a biography of his father,
Louis Marshall: Champion of Liberty. Marshall was also interested in another
family project, that concerning the Florence Marshall Memorial Fund.

James Marshall was honored many times for these and other activities. He
received awards for distinguished public service from the Educators Lodge
B'nai B'rith (1946), distinguished service to New York schools from the Public
Education Association (1952) and for public service in the New York region
from the American Veterans Committee (1952).

Another aspect of James Marshall's career was the publication of both
popular and professional literature. He authored several books: Ordeal by
Glory (1927), Swords and Symbols: The Techniques of Sovereignity (1939,
revised 1969), The Freedom to be Free (1943), Law and Psychology in Conflict
(1966, revised 1971), and Intention in Law and Society (1968).

James Marshall was married for 52 years to Lenore K. Guinzburg (d. 1971)
and had two children, Ellen F. Scholle and Jonathan. In 1974, he married Eva
Garson Levy. James Marshall died at the age of 90 on August 11, 1986 in New
York City.

SCOPE AND CONTENT NOTE top

The JAMES MARSHALL PAPERS (1899-1986) describe the career of James
Marshall, lawyer, leading member of the American Jewish Committee, and active
participant in the field of education. The collection consists mainly of
correspondence, but also includes addresses and writings of Marshall and
information on the Marshall family. The Papers are divided into three series:

			A. CORRESPONDENCE 
			B. WRITINGS 
			C. PERSONAL

The CORRESPONDENCE series (1906-1986) consists of thirty-seven and one-half 
Hollinger boxes of correspondence and some reports, minutes and newsclippings. 
The correspondence is arranged alphabetically by the name of the person or 
organization. Letters are arranged chronologically within each folder. Of 
particular interest in this series is the material pertaining to the American 
Jewish Committee. This material consists of nine Hollinger boxes and documents 
closely the activities of the AJC for the years 1940-1985 and Marshall's 
participation in those activities.

The WRITINGS series (1923-1986) consists of ten Hollinger boxes of
addresses, writings, book reviews and poetry. The materials are arranged
alphabetically by title.

The PERSONAL series (1899-1986) consists of two and one-half Hollinger
boxes of photographs, scrapbooks, school notebooks, family genealogy, and
records of overseas trips made by Marshall. The materials in this series are
arranged alphabetically by topic.
